PTNNT President Director files a police complaint against PT Pukuafu Indah for its baseless accusations |

Jakarta, Tambangnews.com.- Today (16/6/2011), the President Director of PT Newmont Nusa Tenggara (PTNNT), Martiono Hadianto, has filed a police complaint against PT Pukuafu Indah (PTPI) and its President Director Jusuf Merukh to the Indonesian Police headquarters for accusing him [Martiono] of having embezzled the documents of Extraordinary General Meeting of Shareholders (EGMS) held on November 15, 2010. The complaint is made as such an accusation is false and legally baseless.
PT Pukuafu Indah claims that pursuant to an agreement made during the GMS on 15 November 2005 between Nusa Tenggara Partnership (NTP) and Pukuafu, NTP shall be obliged to sell the 31% divestiture shares to Pukuafu. However, PTNNT’s President Director, Martiono Hadianto, confirmed that such GMS as repeatedly claimed by PTPI and Jusuf Merukh was never held.
“Such an EGMS was never held and nothing was stated that PTPI has the right to purchase the remaining divestiture shares. “How could I possibly embezzle any document of an event that has never existed? If the EGMS had been held, PTPI and Jusuf Merukh would have had the data and please show them to the court,” said Martiono Hadianto.
Martiono Hadianto added that the accusation made against him on the embezzlement of documents and the publication in the mass media on the media resulted therefrom have tarnished his reputation. “PT Newmont Nusa Tenggara and I have never committed any offense as accused. “We always comply with all applicable laws and regulations.”
In response to the above, Luhut M.P. Pangaribuan, Legal Attorney to PTNNT and its President Director said, “As regulated under the Indonesian Penal Code (KUHP), embezzlement shall consist of elements of embezzling the property of others. The property allegedly to have been embezzled does not exist as there has never been any event on which the document is based. If the intended property existed, it is the property of PTNNT, not PTPI’s. It is impossible that PTNNT’s President Director has embezzled the company’s documents. Therefore, the allegation stating that PTNNT’s President Director has embezzled PTNNT’s documents is untrue and baseless. As such, we would like to remind PTPI that filing a criminal complaint against any individual while the complainant knows that such individual does not commit any criminal act is punishable by imprisonment for a term of one year and four months, as stipulated in Article 220 of KUHP.**
