Suspension of Concentrate Shipment by Regent not in Line with Procedures |

 Mataram, Tambangnews.com. – PT Newmont Nusa Tenggara (PTNNT) regrets the decision of the Regent of West Sumbawa Regency (KSB) to suspend PTNT concentrate shipment made on 13 January 2011 as it is not in line with the applicable export procedures and may potentially inflict financial losses upon the state and the company.
“PTNNT is a contractor of the Government of Indonesia under the Contract of Work. PTNNT has been operating for 11 years and always complied with all concentrate shipment procedures and regulations. Thus, the suspension on the ground of fulfilling the new regional regulation is not in line with the applicable procedures nor the existing higher-level regulations,” said Arif Perdanakusumah , Senior Manager External Relations of PTNNT.
On Thursday, 13 January 2011 at 17.20 Central Indonesia Time, the Regent of KSB through the Head of the KSB administration team ordered the suspension of PT Newmont Nusa Tenggara concentrate shipment at Benete Port, West Sumbawa. The suspension has been conducted pursuant to letter of the Vice Regent of KSB Number: 540/003/ESDM BUDPAR/I/2011 which in essence would require the President Director of PTNNT to suspend any activity related to the 3rd concentrate shipment until PTNNT obtains Certificate of Goods Origin (SKAB). The letter refers to Regional Regulation (Perda) No. 1 and Regulation of the Regent of KSB (Perbup) Number 30 / 2010 on SKAB.
Regulation of the Minister of Trade No. 43/M-DAG/PER/10/2007 used as the legal basis for the issuance of the Perbub has been revoked and declared null and void pursuant to the provision of Article 12 of Regulation of the Minister of Trade No. 33/M-DAG/PER/8/2010 and KSB is not an SKA issuing authority (IPSKA). Pursuant to the existing provisions, the authority/official in the capacity as IPSKA must first be appointed by the Director General on behalf of the Minister.
Regulation of the Minister of Trade Number 60/M-DAG/PER/12/2010 states that the only government instrumentality authorized to issue SKA (Certificate of Origin) for goods originating from NTB is the Provincial Industry and Trade Office of NTB.
Arif is hopeful that the regional, provincial and central governments can immediately resolve this matter. ”We believe that all parties understand the importance of resolving this matter soon so that PTNNT can perform its duties as the contractor of the Government of Indonesia as mandated by the Contract of Work and it can give investment legal certainty in Indonesia,” added Arif.
”The concentrate shipment and export procedures that have so far been implemented by PTNNT have been in compliance with the government regulations and internationally applicable trade practices with rigorous testing protocol and verified by verified by the verification agency (PT Surveyor Indonesia) officially appointed by the Government. This process is also under the supervision of an Indonesian Government team that involves representatives of the Regional Governments of KSB and NTB.
”We will meet with the Regent of West Sumbawa to explain the situation and have a discussion with him to resolve the differences,” said Arif. **
